PINTEL Communication, Inc. Terms of Service (Rev. October 31, 2021)

These Terms of Service constitute the agreement (“Agreement”) between PINTEL Communication Inc. (“we,” “us” or “PINTEL”) and the user (“you,” “user” or “Customer”) of PINTEL’s residential and small business communications services (“Service”). This Agreement governs both the Service and any devices, such as an IP phone, IP Softphone, Analog Telephone Adapter or any other IP or Wireless Mobile connection device, sold or otherwise furnished/Provided to or by You and used on PINTEL Global Networks (“Device” or “Equipment”), and also applies to all lines on each PINTEL account.

1.1 911 Dialing.

PINTEL 911 Dialing is different than traditional 911 service offered by traditional telecommunications carriers. Most of our customers have access to either basic 911 or Enhanced 911 (E911) service. With E911 service, when you dial 911, your telephone number and registered address are simultaneously sent to the local emergency center assigned to your location, and emergency operators have access to the information they need to send help and call you back if necessary. Customers in locations where the emergency center is not equipped to receive your telephone number and address have basic 911. With basic 911, the local emergency operator answering the call will not have your call back number or your exact location, so you must be prepared to give them this information. Until you give the operator your phone number, he/she may not be able to call you back or dispatch help if the call is not completed or is not forwarded, is dropped or disconnected, or if you are unable to speak. As additional local emergency centers become capable of receiving our customers’ information, PINTEL will automatically upgrade customers with basic 911 to E911 service. PINTEL will not give you notice of the upgrade.
You authorize disclosure of your name and address to third-parties involved with providing 911 Dialing to you, including, without limitation, call routers, call centers and local emergency centers.

1.2 Notify All Voice Service Users.

You should inform any household residents, guests and other third persons who may be present at the physical location where you utilize the Service of the important differences in and limitations of PINTEL 911 Dialing as compared with basic 911 or E911.

1.3 Registration of Physical Location Required. (Voice & Mobile Service Users)

For each phone number that you use for the Service, you must register the physical location where you will be using the Service with that phone number. When you move the Device to another location, you must register your new location. If you do not register your new location, any call you make using the 911 Dialing feature may be sent to an emergency center near your old address. You will register your initial location of use when you subscribe to the Service. Thereafter, you may register a new location by following the instructions from the “911″ registration link on your PINTEL web account dashboard features page, or until such feature is available, sending an email to For purposes of the 911 Dialing feature, you may only register one location at a time for each phone line you use with the Service. Regardless of what address you register, emergency calls you make from these devices will be routed to the national emergency response center.

1.4 Confirmation of Activation Required (Voice Service Users)

Your 911 Dialing feature will not be activated for any phone line that you are using with the Service, unless and until you receive an email from us confirming that the 911 Dialing feature has been activated for that phone line.

1.5 Service Outages (Voice Service Users)

(a) Service Outages Due to Power Failure or Disruption. 911 Dialing does not function in the event of a power failure or disruption. If there is an interruption in the power supply, the Service, including 911 Dialing, will not function until power is restored. Following a power failure or disruption, you may need to reset or reconfigure the Device prior to utilizing the Service, including 911 Dialing.

(b) Service Outages Due to Internet Outage or Suspension or Disconnection of Broadband Service or ISP Service. Service outages or suspensions or disconnections of service by your broadband provider or ISP will prevent all Service, including 911 Dialing, from functioning.

(c) Service Outage Due to Disconnection of Your PINTEL Account. Service outages due to disconnection, suspension or termination of your account will prevent all Service, including 911 Dialing, from functioning.

(d) Service Outages Due to ISP or Broadband Provider Blocking of Ports or Other Acts. Your ISP or broadband provider or other third party may intentionally or inadvertently block the ports over which the Service is provided or otherwise impede the usage of the Service. In that event, provided that you alert us to this situation, we will attempt to work with you to resolve the issue. During the period that the ports are being blocked or your Service is impeded, and unless and until the blocking or impediment is removed or the blocking or impediment is otherwise resolved, your Service, including the 911 Dialing feature, may not function. You acknowledge that PINTEL is not responsible or liable in any way for the blocking of ports by your ISP or broadband provider or any other impediment to your usage of the Service, and any loss of service, including 911 Dialing, which may result. In the event you lose Service as a result of blocking of ports or any other impediment to your usage of the Service, you will continue to be responsible for payment of the Service charges unless and until you disconnect the Service in accordance with this Agreement.

(e) Other Service Outages. If there is a Service outage for any reason, such outage will prevent all Service, including 911 Dialing, from functioning. Such outages may occur for a variety of reasons, including, but not limited to, those reasons described elsewhere in this Agreement.

1.6 Re-Activation Required if You Change Your Number or Add or Port New Numbers.

911 Dialing does not function if you change your phone number or if you add or port new phone numbers to your account, unless and until you successfully register your location of use for each changed, newly added or newly ported phone number.

1.7 Network Congestion; Reduced Speed for Routing or Answering 911 Dialing Calls.

There may be a greater possibility of network congestion, delays and/or reduced speed in the routing of a 911 Dialing call made utilizing the Service as compared to traditional 911 dialing over traditional public telephone networks, including where emergency calls are first routed through a national emergency center.

Wi-Fi Features (Mobile Wireless Service).

PINTEL or Carrier, at their sole discretions, may make available Wi-Fi voice and text messaging services, i.e., the ability to originate and terminate calls and text messages over a Wi-Fi connection (“Wi-Fi Calling”). If offered by PINTEL, Wi-Fi Calling will only be available for PINTEL Resellers or End Users that (i) have a Wi-Fi capable Device with PINTEL supported Wi-Fi calling capability, (ii) have Wi-Fi Calling service provisioned on their account, (iii) have a compatible SIM card, and (iv) are connected to functioning third-party internet service. Not all services available on the Carrier's Network are available while using Wi-Fi Calling. For example, emergency alerts may not be available with Wi-Fi Calling. You acknowledge that calling 9-1-1 via Wi-Fi Calling uses the internet and operates differently than traditional 9-1-1. For example, 9-1-1 may not work during power or internet outages or disruptions, or if internet or your Service is suspended. Location information when using Wi-Fi Calling may be limited or unavailable. When you call 9-1-1 over Wi-Fi away from your primary address, we and the Carrier may have no or very limited information about your location. Neither PINTEL nor the Carrier are responsible or liable for anything related to your use of or inability to use any Wi-Fi Calling MADE AVAILABLE TO you, including, without limitation, any failure of emergency calls (whether 9-1-1 calls or otherwise). Wi-Fi Calling may decrement Rate Plan minutes. Most Devices will not transition between Wi-Fi and the wireless Network. Devices using wireless connections may be vulnerable to unauthorized attempts to access data and software stored on the device.

Emergency Alerts (Mobile Wireless Service)

PINTEL and it's Carriers participates in the wireless emergency alerts program administered by the federal government within portions of its Network. This allows federal, state, and local government agencies to send alerts about local emergencies to Customers in specifically defined geographic areas. Wireless alert capable Devices with appropriate notification settings are required for the service. There is no additional charge for these wireless emergency alerts.

911 Access. 911 services are made possible by your state and local government. Check to see if your Devices are capable of making calls to 911 in the United States. The Device must have battery power and Network connectivity to complete a 911 call. When making 911 calls, you should be prepared to provide information about where you are located. In some cases, 911 communications center operators may not know your phone number or have information about your location. Other third-party entities are involved in connecting a 911 call and PINTEL does not determine the public safety agency to which your 911 call is routed. If you are porting a phone number to or from us, while the port is in process, we may not be able to provide you with some Services, such as 911 location services. If you are outside the U.S., you may have to dial a different number than 911 to call emergency services.

1.8 Disclaimer of Liability and Indemnification.

We do not have any control over whether, or the manner in which, calls using our 911 Dialing service are answered or addressed by any national or local emergency response center. We disclaim all responsibility for the conduct of local emergency response centers and the national emergency calling center. We rely on third parties to assist us in routing 911 Dialing calls to local emergency response centers and to a national emergency calling center. We disclaim any and all liability or responsibility in the event such third party data used to route calls is incorrect or yields an erroneous result. Neither PINTEL nor its officers, employees or agents may be held liable for any claim, damage, or loss, and you hereby waive any and all such claims or causes of action, arising from or relating to our 911 Dialing service unless such claims or causes of action arose from our gross negligence, recklessness or willful misconduct. You shall defend, indemnify, and hold harmless PINTEL, its officers, directors, employees, affiliates and agents and any other service provider who furnishes services to you in connection the Service, from any and all claims, losses, damages, fines, penalties, costs and expenses (including, without limitation, attorneys fees) by, or on behalf of, you or any third party relating to the absence, failure or outage of the Service, including 911 Dialing, incorrectly routed 911 Dialing calls, and/or the inability of any user of the Service to be able to use 911 Dialing or access emergency service personnel.

1.9 Alternate 911 Arrangements.

If you are not comfortable with the limitations of the 911 Dialing service, you should consider having an alternate means of accessing traditional 911 or E911 services or disconnecting the Service.

2.1 Monthly Service Term.

Service is offered on a monthly basis for a term that begins on the date that PINTEL activates your Service and ends on the last day of the first full calendar month after such activation date. You are purchasing the Service for full monthly terms, meaning that if you attempt to disconnect Service prior to the end of a monthly term, you will be responsible for the full month’s charges to the end of such monthly term, including, without limitation, unbilled charges, plus a disconnection fee, if applicable, all of which will immediately become due and payable. You will also be responsible for the next full month’s charges in the event that you do not provide the requisite ten (10) day notice of disconnection prior to the expiration of the then-current term. PINTEL Service is designed to work generally with unencumbered high-speed internet connections. However, if the high-speed internet connection you are using is outside the United States and/or your ISP places restrictions on the usage of VoIP services, Services may not be available or may be degraded or otherwise inoperable. PINTEL does not represent or warrant that use of the PINTEL Service by you is permitted by any other jurisdictions or by any or all the ISPs. Privacy Policy

Updated effective May 24, 2020

At PINTEL, we are committed to honoring the privacy of our customers and visitors to our website. We recognize the importance to you, our website customer or visitor ("you"), of maintaining an appropriate level of privacy and security for the personal information we collect from you through this website. We store your data safely and handle it with the utmost care and in accordance with applicable law.

The following policy governs the use of the site as well as the services offered by PINTEL, including our gathering, use and disclosure practices with respect to your information that is collected by us or provided by you on and through this website. By accessing or using our site, you acknowledge that you have read and accepted the practices, procedures and terms and conditions of this policy and any other terms of use or policies posted by us. Please note that this privacy statement applies only to this site and not to the websites of our advertisers or of other companies or organizations to which we link. All references to "PINTEL" throughout this policy statement include, unless otherwise stated, all PINTEL affiliate companies, successors and assigns. By using PINTEL’s website and services, you consent to the use of personal data and other information in accordance with the terms of this Privacy Policy.

Policy Revisions

We may, from time to time, change this privacy policy with or without notice. If you have any questions regarding this privacy policy, you may email us at:

PINTEL complies with all data privacy laws and directives, including the General Data Protection Regulation (EU) 2016/679 ("GDPR").

Since our customers integrate our products in their software applications, we don’t interact with their end users directly. When customers do share end user information with us, we always handle the data in accordance with data protection regulations, including the GDPR. We don’t use that data for any purposes other than specifically issued by the customer who provides the data, or to the extent required under law.
You’ll encounter the terms "controller" and "processor" in this policy. By "controller", we mean the company that an individual ("data subject") provides their personal data to. The controller determines the purpose for the personal data and is responsible for the correct handling of the data subject’s data. By "processor", we mean the company that provides part of the services to the controller, and needs specific personal data in control of the controller in order to do so.

Depending on your relationship with PINTEL, we may both be a controller and a processor. When PINTEL processes the contents of communications provided by a customer, as between PINTEL and the customer, generally PINTEL is a processor. When PINTEL processes communications metadata, PINTEL is a processor in many respects, but may act as a controller in others. When PINTEL processes your personal data that you have provided to us through our portal or otherwise, PINTEL is acting as a controller. When PINTEL is acting as a controller or a processor, it always ensures that the parties we work with adhere to GDPR. Additionally, we ensure that another party will not use the data you have entrusted to us for any other purpose than delivering the services you have purchased.

What Kinds of Information Does PINTEL Collect and Use?
